Terms and Conditions

These Terms and Conditions apply to the use of the Bizi Media website and to services purchased from Bizi Media, including the Local Lead Website offer and ongoing website care. By purchasing a service from us, you agree to these terms.

1. About Bizi Media

In these terms, “Bizi Media”, “we”, “us” and “our” refer to Bizi Media. “You” and “your” refer to the customer purchasing or using our services.

2. The Local Lead Website offer

The Local Lead Website is a focused one-page WordPress website for small and local businesses that want a clear, enquiry-focused online presence.

The introductory build price is A$299 for the first 20 accepted and paid businesses. After the introductory allocation is filled, the build price is A$399, unless another price is clearly stated before you pay.

The Local Lead Website is not intended for ecommerce stores, large catalogues, memberships, marketplaces, complex booking systems or substantial custom development. If your requirements fall outside the offer, we may recommend a separately scoped project instead.

3. Application, acceptance and payment

Submitting an application does not reserve a place. Your place is secured only after Bizi Media accepts the project and the website build payment is completed.

The website build fee is paid upfront through our checkout provider, Stripe. Available payment methods may include card, Apple Pay, Google Pay, Afterpay/Clearpay and Link, depending on Stripe availability and customer eligibility. Payment details are processed by Stripe and are not stored by Bizi Media.

4. What is included in the website build

Unless otherwise agreed in writing, the Local Lead Website build includes:

  • business, customer and market research;
  • website strategy and enquiry-focused structure;
  • copywriting for the one-page website;
  • professional website design;
  • desktop, tablet and mobile setup;
  • clear calls to action and enquiry pathways;
  • WordPress website build and technical setup; and
  • reasonable setup required to prepare the website for launch.

You do not need to prepare a detailed website brief or write the website copy yourself.

5. Onboarding and information you provide

After payment, you will be directed to book a 30–45 minute onboarding call. You agree to provide accurate information about your business, services, pricing, service areas, contact details and any claims you want included on the website.

If you have a logo, photos, testimonials or other business material you want us to consider, you should provide them promptly. Photos are optional. Logo design is not included in the Local Lead Website build unless specifically stated or purchased separately.

You confirm that you have permission to use any logos, images, testimonials, trademarks, text or other material you provide to us.

6. Delivery timeframe

We aim to deliver a completed Local Lead Website within two weeks after we have the information we reasonably need to begin. Websites are often completed sooner when our build queue allows.

This is a target rather than a guaranteed deadline. Delivery may take longer if required information is delayed, your requirements change, third-party services cause delays, or the project falls outside the agreed scope.

7. Review period and Satisfaction Guarantee

When your completed website is delivered for review, we will also send your first ongoing website care invoice or subscription request.

You then have 3 days to review the completed website, send reasonable minor copy or factual corrections, raise any genuine concern and complete the first ongoing care payment.

If you raise a genuine concern during the 3-day review period, we will work with you to reasonably resolve it. If the concern cannot reasonably be resolved and you are still not satisfied, you may cancel the website under our Satisfaction Guarantee and we will refund the website build payment.

After the 3-day review period, the website build is treated as accepted and the cancellation/refund period under the Satisfaction Guarantee ends. Reasonable minor updates can still be requested under ongoing website care.

A refund is not normally provided simply because you change your mind, except where our Satisfaction Guarantee applies or where you are entitled to a remedy under law.

8. Australian Consumer Law

Nothing in these Terms limits, excludes or modifies any rights or remedies that cannot lawfully be limited, excluded or modified, including any rights that may apply under the Australian Consumer Law.

Our Satisfaction Guarantee is a separate voluntary promise from Bizi Media and does not replace or reduce any rights you may have under Australian law.

9. Ongoing website care

Ongoing website care is required while Bizi Media hosts and manages the Local Lead Website.

The current standard price is A$50 per month. You begin with a A$10 per month goodwill discount, making the current ongoing price A$40 per month while your subscription remains in good standing. Ongoing service pricing may change in accordance with the Changes to Ongoing Service Pricing clause below.

Goodwill Discount and Late Payment

If an ongoing payment is not received by the due date, Bizi Media may withdraw the A$10 per month goodwill discount and the ongoing service may revert to the standard A$50 per month rate from the next billing period.

If hosting, email or website care is suspended or disconnected because payment remains overdue, a A$20 reconnection fee may apply before the service is restored, in addition to any outstanding amount.

Restoration of service may take a reasonable period after all outstanding charges and any applicable reconnection fee have been paid.

Bizi Media may choose to waive a late-payment consequence or reconnection fee in an individual case, but doing so does not create an ongoing entitlement to that waiver.

Ongoing website care includes:

  • website hosting;
  • one business email address using your domain, with up to 2 GB of server storage;
  • website management and routine maintenance;
  • reasonable minor updates to existing website content; and
  • reasonable support relating to the hosted website.

Additional business email addresses are available for A$10 per month each.

A minor update generally means a small change to existing text, contact details, an existing image or similar existing page content that does not require redesign, new functionality, extensive research, significant copywriting, custom coding or substantial labour.

Ongoing website care includes reasonable minor updates to the existing website at Bizi Media’s discretion. Bizi Media may decline a requested minor or major update where the request is outside the agreed service, technically unsuitable, unlawful, inconsistent with the website strategy, commercially unreasonable, beyond available capacity or otherwise not work Bizi Media wishes to undertake.

10. Additional Work and Changes

Requests for new pages, new sections, redesigns, new functionality, integrations, major copy changes, substantial image or content changes, custom development, migrations or other work outside the existing website care scope will be treated as additional work.

Before additional work begins, Bizi Media will review the request, define the scope where reasonably possible and provide a price or estimate. Additional work will only proceed after the customer agrees to the scope and price.

Bizi Media may decline any requested additional work. If Bizi Media declines the work, the customer may engage another provider, subject to any applicable technical access, licence, security or hosting limitations.

11. Changes to Ongoing Service Pricing

Bizi Media may change the price of hosting, website care, email hosting or other ongoing services from time to time.

Where the price of an existing ongoing service is increased, Bizi Media will provide at least 30 days’ notice before the new price takes effect.

The new price will apply from the customer’s next billing period after the notice period ends. If the customer does not agree to the new price, they may cancel the affected ongoing service before the new price takes effect without a cancellation fee or penalty.

Any amount already paid for the current billing period remains unchanged.

12. Cancelling ongoing website care

There is no long-term lock-in for ongoing website care. You may cancel at any time. Your Bizi Media-hosted website and email will remain active until the end of the billing period already paid for.

Your domain name remains yours.

If you want to move the WordPress website elsewhere, you may request a .wpress website export for A$20 to cover manual processing. Bizi Media licences, subscriptions and other non-transferable third-party licences do not transfer with the website.

You are responsible for downloading, transferring or archiving any email you wish to keep before the hosted service ends.

13. Domains, software and third-party services

Your domain remains your property, provided it is registered in your name or business name. Where reasonably required, you authorise us to make normal DNS or technical changes needed to connect the website, hosting or email.

Our services may rely on WordPress, hosting infrastructure, plugins, payment providers, email systems, domain registrars, DNS providers, search engines and other third-party services. Third-party services may change, experience outages, suspend services, alter policies or impose their own terms. We will take reasonable steps to maintain the service, but we cannot guarantee that every third-party system will always be available, uninterrupted or unchanged.

To the maximum extent permitted by law, Bizi Media is not responsible for loss caused by the acts, omissions, outages, suspensions, policy changes or failures of third-party services outside Bizi Media’s reasonable control.

Website backups are maintained primarily for operational recovery and are not a guaranteed permanent archive. Customers should retain copies of important business records, emails and content they cannot afford to lose.

While Bizi Media takes reasonable steps to protect hosted websites and related services, no website, hosting platform or email system can be guaranteed to be completely secure or immune from hacking, malware, phishing, unauthorised access or data loss.

14. Website licences and reusable Bizi Media systems

Once your website build fee has been paid, you may use the completed website for your business subject to these terms.

Your business name, logo, domain and material you provide remain yours. Bizi Media retains ownership of its reusable processes, methods, systems, templates, know-how and any licences or subscriptions held by Bizi Media.

Where a third-party asset or software licence is supplied under a Bizi Media licence, that licence does not automatically transfer if the website moves to another provider.

15. SEO, rankings, enquiries and business results

We build Local Lead Websites with sound SEO and conversion foundations, but we do not guarantee Google rankings, traffic, visitors, calls, enquiries, bookings, customers, sales, revenue, profit, conversion rates or any other business result.

Results can be affected by competition, location, demand, your Google Business Profile, reviews, advertising, links, content, pricing, offers, sales follow-up, market conditions and many other factors outside Bizi Media’s control.

The customer remains responsible for their own business decisions, marketing decisions, offers, pricing, customer follow-up, sales process and use of the website.

16. Customer responsibilities

You are responsible for checking that information about your business is accurate and lawful, including prices, claims, licences, qualifications, service descriptions and any industry-specific statements.

You must not use the website, hosting or email service for unlawful, fraudulent, abusive, malicious or prohibited activity.

17. Limitation of Liability

Nothing in these Terms excludes, restricts or modifies any right, guarantee, liability or remedy that cannot lawfully be excluded, restricted or modified.

To the maximum extent permitted by law, Bizi Media is not liable for any indirect, incidental, special or consequential loss arising out of or in connection with the services, including loss of profit, loss of revenue, loss of business, loss of opportunity, loss of anticipated savings, loss of goodwill, loss of customers, loss of enquiries, loss of rankings, loss of traffic or loss of sales.

To the maximum extent permitted by law, Bizi Media’s total aggregate liability arising out of or in connection with a service is limited to the total amount actually paid by the customer to Bizi Media for the specific service giving rise to the claim.

To the maximum extent permitted by law, Bizi Media is not responsible for loss caused by customer-supplied errors, inaccurate or unlawful customer content, unauthorised access resulting from credentials outside Bizi Media’s control, third-party outages or failures, or changes made by the customer or another provider after Bizi Media’s work has been completed.

18. Website content and links

Information on the Bizi Media website is provided for general information and may be updated from time to time. Our website may link to third-party websites or services. A link does not necessarily mean we endorse or control the third party, and we are not responsible for third-party content or availability.

19. Changes to these terms

We may update these terms for future purchases and services. If a material change affects an existing ongoing service, we will provide reasonable notice where appropriate. If you do not agree to a material change to an ongoing service, you may cancel the service before the change takes effect, subject to any rights that apply under law.

20. Dispute Resolution

Before commencing legal proceedings relating to the services, the customer must first give Bizi Media written notice of the dispute and reasonable details of the issue. The parties must then make a genuine attempt to resolve the dispute directly and, where appropriate, through mediation before commencing court proceedings.

This clause does not prevent either party from seeking urgent interlocutory relief or exercising any right that cannot lawfully be restricted.

21. Governing law

These Terms are governed by the laws of New South Wales, Australia. Subject to any mandatory legal rights that apply, the parties submit to the jurisdiction of the courts of New South Wales.
